EXCLUSIVE: Attorney claims police interrogation video reveals civil rights violations
How many of the youth locked up in Adult Facilities are there because of this? How about Tory Adamcik, could he have been railroaded? During the second "Interview" they began by Mirandizing him, later he said, "Before I say anything else I want to talk to a Lawyer," the Detectives packed it up and rushed Sean and Shannon from the room, leaving Torey to dwell on what was happening, pretty much the last things that the Detectives said, something to the effect, "We know you were there, we can place you there, we have a witness." of course their witness was Brian Draper, but the did not tell him that.
Then they rushed the parents out, and did the buddy buddy thing, got them coffee, and sat and talked, This is where they get the family to feel like they are friends and trying to help their son out, but to do that they need him to talk and give his side of the story. During this time they give the impression that they have contacted the Attorney and are just waiting for him to get there.
Finally having the parents feeling comfortable, they say, let's go sit with Torey while we wait, Dad you can talk to him and explain things to him until the Lawyer gets here. Then they go into the room, take seats back against the wall with Mom and Dad up at the table next to Torey, and Dad tells Torey everything the Detectives told him to say, asked the questions that they gave him - basically became their agent against their son.
Then after all of that, they figure they have enough, say it is late we will pick this up again tomorrow, but for tonight, "Torey, you are being placed under arrest for 1st degree murder, for the killing of Cassie Jo Stoddart.

Here's my voice...Torey Adamcik and Brian Draper are killers and are where they need to be for the rest of their life. End of story that will never ever change.

ReplyDeleteThe unfair treatment and trial of Torey Adamcik. The Prosecutor disallowed the Defense to offer any Defense, AND he allowed ALL evidence that was to be used in Torey's trial to be published in Print as well as TV News Broadcasts, which is a major violation of the law.
In the Post Conviction hearing held recently the Defenses Forensic Scientist was allowed to testify, and proved that only ONE (1) knife was used. The Judge OPENLY admitted that Torey had ineffective council at trial, but still refused the Post Conviction release being approved.
The many hours of research of the case, and of Idaho Law tells me that Torey is guilty of three things: # 1- being naive and trusting Juvenile! # 2- Obstruction of Justice by assisting Draper in hiding and trying to destroy evidence. # 3- Harboring a felon, by not telling his parents or the Police about the Murder.
Now let's go back to the investigation; Torey's Miranda Warnings were violated, when the police made threats against his parents, after they had demanded that Torey's Attorney be present before any questioning. Torey did admit to being there earlier in the evening, therefore you would expect to find his fingerprints in the house. He admitted to being in the garage at the time that Draper went upstairs and murdered Cassie, HOWEVER he to this day states he NEVER went upstairs at that time.
The investigation turns up none of Torey's DNA on any evidence that was actually murder related, there was only one pair of footprints leading away from the murder scene, down the stairs and out the front door. The video tape had been damaged and had to be repaired, and there is 15 to 30 minutes missing from the recording; After the murder you hear Draper say, "I killed her man, I stabbed her and watched the life leave her eyes."
What you hear Torey say, "Shut Up! Man we have to get our acts together." What you also hear in that phrase is fear, shock, and inability to believe that Draper had actually killed Torey's friend.
Now about the 15 or 30 minutes of missing Video, the state says it was too dark so no Video, what about the audio, had Draper filmed the murder as he states, even if it was to dark you would have been able to hear voices, had Torey been there his voice as well as Draper's and Cassie's would have been recorded. That time frame is missing.
Draper has admitted that he wanted to be famous like the two that committed the Columbine Shootings and bombings. Well he got his wish.
Torey wanted only one thing and that was to be famous as a Director of Slasher / Horror films. He admits to making the video with Draper, but Swears that he thought that it was going to be a movie, at NO time did he believe that Draper was really going to kill anyone. ALSO remember if you watched that video, or listened to the audio from the video, there was a list of people to be killed,.and if Torey was truly involved in Cassie's Murder there would have been many more that night.
There are many questions raised in my mind from this case, and as a professional Legal Researcher I would have to say that there is no way that I could find Torey guilty of ANYTHING other than being a dumb teenager, who wanted to make a film, and trusted the wrong guy to do it with.
Again Lynn you are entitled to your opinion, as are we, and if you could come up with the answers to the thousands of questions raised by this case, maybe you could convince me. As sits right now, I fully believe that Torey is in no way guilty of the Murder.
